VISAKHAPATNAMMr. P. Jagannadha Rao, judge of the
Human Rights Court, on Thursday transferred the case
filed by the eight Sri Lankan nationals who have been
released from Jail but still detained to Fifth
Metropolitan Magistrate Court.
Referring to a High Court observation that the Human
Rights Act, which was similar to the SC and ST
Atrocities (Prevention) Act, had no provision enabling
the Special Judge to take cognizance, the judge
transferred the case to the lower court for disposal
and directed the police and the petitioners to appear
before that court on July 2.
The Sri Lankan nationals (originally nine in number
but one of them, T. Mohan, has since left for Bahrain
in May after his relatives secured a passport and a
no-objection certificate for him) sent a petition to
the then Principal District Judge to find a way for
them to leave India. The petition was sent to the
Human Rights Court. The case was with this court for
several months. A professor from the Andhra University
College of Law submitted his opinion as sought by the
court.
They were lodged in a special camp set up in the town
police station premises since they were released from
the Central Prison here in August last. Since January
1993 when they were arrested, the Sri Lankan nationals
have been in police custody and trying to find a way
to leave the country.
The eight, N. Jeyachandra, Kesavan, S. Sivarasan, S.
Indralingam, A. Subhash Chandra, S. Balakrishna, K
Satkunalingam and V. Krishnamurthy, were present in
the court.
